European Commission Blames Social Networks For ACTA Failure; Worried About Its Imminent Directive On Copyright Enforcement
Now that the EU's ratification of ACTA has departed from the original script of everyone just waving it through, the European Commission is clearly trying to come up with Plan B. Some insights into its thinking can be gained from the minutes (pdf) of a recent Commission meeting, pointed out to us by André Rebentisch.
Here's what the President of the European Commission, José Manuel Barroso, said about ACTA:
" The President introduced the topic, commenting on the intensity and scale of the public debate and the organised campaign against the Anti-Counterfeiting Trade Agreement (ACTA). There were those in particular who felt that the agreement would lead specifically to an unwarranted restriction on freedom of expression and democracy on the Internet, and would distort the reasonable balance between intellectual property rights and other fundamental rights.
He therefore felt that the Court of Justice of the European Union should be asked to confirm the Commission’s position in this matter, namely that ACTA was consistent and compatible with the Treaties and with the Charter of Fundamental Rights of the European Union. He suggested that that day’s discussion should consider that point, but also the question of when would be an appropriate time to refer the matter to the Court, and the possibility of consulting Parliament and the Council with a view to adopting a common approach in this matter."</p>

Hackers Steal Unreleased Michael Jackson Tracks from Sony
The plot thickens, and Sony once again has found itself in the news surrounding another hacking-related incident. This time around, the breach doesn’t appear to be in regard any lost user data or customer accounts, but instead, some valuable property owned by the record company.
Today, the UK’s Daily Star and other British news outlets have reported that more than 50,000 music tracks have been illegally accessed and downloaded by hackers, including a large number from the late Michael Jackson.

Presseverlage gegen den Rest der Welt
Wie heute früh schon kurz berichtet, haben sich FDP und CDU/CSU auf die Einführung eines Leistungsschutzrechts für Presseverlage geeinigt (Seite 4). Gewerbliche Onlineangebote sollen für die Nutzung von Presseerzeugnissen (“oder kleiner Teile davon”) zahlen, die Abwicklung findet nach den Vorstellungen der Koalition über eine neue Verwertungsgesellschaft statt. Primäres Ziel der Initiative ist Google, das den Verlegern seit langem ein Dorn im Auge ist (obwohl sie stark davon profitieren).

Gefälschte Transparenz im EU-Parlament
Im Europäischen Parlament fand am letzten Donnerstag (1. März) die Hauptveranstaltung zu ACTA statt. Eingeladen waren einige Kommissionsbeamte und – für das Podium zu Grundrechtsfragen – sogar ein Urheberrechts-Anwalt, der sich auf Nachfrage aus dem Publikum als Lobbyist der Markenvereinigung INTA entpuppte. Als einziger offensichtlicher ACTA-Gegner durfte Michael Geist, Professor an der Universität Ottawa, sprechen. Vertreter der Zivilgesellschaft wurden nicht eingeladen. Obwohl man also allen Grund hatte pessimistisch zu sein, wurde man während des Workshops angenehm überrascht – die Stimmung im Saal war klar gegen das Abkommen.

Die Zukunft des Internet in den Händen der UNO
Aus den USA sind Warnrufe zu vernehmen, dass auf einer kommenden Konferenz der Internet Telecommunition Union (ITU) die Freiheit des Internet massiv gefährdet wäre. Die Kassandrarufe sind zwar gemischt mit einer gehörigen Portion von Eigeninteresse und richten sich vermutlich an den falschen Adressaten. Völlig von der Hand zu weisen sind sie jedoch nicht.
Diese Woche begannen in Genf diplomatische Verhandlungen zu den „International Telecommunication Regulations“ – einem völkerrechtlichen, weltweit geltenden Vertrag, der den Betrieb und die Abrechnung internationaler Telekommunikationsdienste umfasst. Seit dessen Verabschiedung im Jahr 1988 hat sich die Telekommunikationswelt dramatisch verändert: Viele der ehemaligen staatlichen Telekombetreiber sind inzwischen privatisiert, eine Vielzahl von Wettbewerbern tummelt sich auf dem Markt. Vor allem aber hat das Internet die Marktstrukturen völlig verändert. Ende des Jahres soll deshalb auf der Konferenz WCIT-12 der Vertrag in trockene Tücher gebracht werden.

ACTA: EU-Parlament stellt sich Kritik
Fast vier Stunden lang diskutierten Kommissionsvertreter und Parlamentarier heute Nachmittag mit internationalen Rechtsprofessoren und einer Hundertschaft von ACTA-Kritikern.
"Auf den Stufen sitzen ist aus feuerpolizeilichen Gründen leider nicht erlaubt" - so eröffnete der Vorsitzende des parlamentarischen Handelsausschusses (INTA), Vital Moreira, den Workshop über das umstrittene ACTA-Abkommen. 20 Minuten vor Beginn war die öffentliche Veranstaltung im Europaparlament bereits ausgebucht, die vielen anderen Interessierten aus der Zivilgesellschaft wurden in einen Raum mit Live-Übertragung geleitet.

Suchergebnisse von Anti-SOPA-Blogs von Rechteindustrie zensiert
Am vergangenen Wochenende wurden zwei SOPA- und PIPA-kritische Blogbeiträge von Techdirt und Torrentfreak aus den Google-Suchergebnissen ausgeschlossen. Die Sperrung erfolgte aufgrund eines (falschen) Hinweises des US-Contentverwerters Armovore.
Durch die im “Digital Millennium Copyright Act” (DMCA) vorgeschriebene “Notice and Takedown”-Politik müssen in den Vereinigten Staaten Webseiten mit urheberrechtsverletzenden Inhalten von Suchmaschinenanbietern ohne weitere Überprüfung gesperrt werden. Die Inhaber der Seiten werden über die Streichung aus den Suchergebnissen nicht unterrichtet.

'We, The Web Kids': Manifesto For An Anti-ACTA Generation
One of the striking features of the demonstrations against ACTA that took place across Europe over the last few weeks was the youth of the participants. That's not to say that only young people are concerned about ACTA, but it's an indication that they take its assault on the Internet very personally -- unlike, perhaps, older and more dispassionate critics.
As sometimes happens, a text has been floating around that captures rather well the spirit of that generation. It was originally written in Polish, and released under a liberal cc-by license; there are now a number of translations. As its author, Piotr Czerski, wrote in an email to Techdirt, its origins were quite humble:
I was asked by the journalist from local newspaper to write a text explaining difference between "analog" and "digital" generations. I thought that I should write something more: text, which can offer some kind of self-identity for all this different people protesting against ACTA. So I used the poetics of manifesto.

ACTA-Farce im EU-Parlament
"Unsere Verantwortung als Politiker ist, Tatsachen zu schaffen und nicht der Masse folgen" sagte EU-Kommissar Karel de Gucht zu den Protesten. Weitere, geheimgehaltene ACTA-Dokumente sind aufgetaucht.
Die mit einiger Spannung erwartete öffentliche Sitzung des Handelsauschusses (INTA) zum Thema ACTA verlief am Mittwoch Nachmittag so, wie bisher stets mit dem umstrittenen Abkommen umgegangen wurde.

Kim Dotcom Remains Free on Bail As U.S. Appeal Fails
Kim Dotcom remains free on bail after United States authorities lost an appeal of an earlier decision by a New Zealand court to grant him bail. Justice Brewer dismissed the appeal, which was put forward by New Zealand Crown lawyers on behalf of the U.S. government, in the Auckland High Court late Wednesday afternoon, local time.
Dotcom, the outsized founder of Megaupload and associated file locker sites, is accused of masterminding a business that made more than $100 million by charging users to watch and download copyrighted material. Megaupload’s lawyers say the site complied with U.S. copyright laws, despite being based in Hong Kong, and that like any other internet company it is not responsible for policing its own site for copyright violations.
