APPLE AND AT&T SUED FOR $1.2 BILLION OVER iPHONE
On Friday, October 5, 2007, the law offices of Folkenflik & McGerity and Hoffman & Lazear filed a $1.2 billion class action on behalf of owners of the iPhone against Apple, Inc. and AT&T Mobility, LLC (the AT&T cellular telephone carrier) in the United States District Court for the Northern District of California, in San Jose, Paul Holman and Lucy Rivello v. Apple, Inc., AT&T Mobility, LLC. The case asserts claims under the Federal antitrust laws, California antitrust laws and California unfair trade practices laws, based on Apple and AT&T’s agreements to restrict iPhone users to using only the AT&T cellular network for voice and data, and to restrict iPhone users to only using applications from Apple.
